UPDATE - Changes to R&D Tax Credits
Following the Chancellor’s Budget statement and our summary, we will be sending out greater detail on various key measures and the implications of each.
One such matter relates to changes to R&D tax credits going forward, notably to those claims under the SME scheme.
The crux of the change is the capping of claims to £20,000 plus 3x the company’s total PAYE and NI liability for the year for period starting on or after 1 April 2021.
Companies whose claims do not exceed £20,000 will remain unaffected.
Those who satisfy the following two tests will also remain unaffected:
- That a company’s employees are creating, preparing to create or actively managing Intellectual Property (IP) arising from the R&D project
- That expenditure on work subcontracted to a related party is less than 15% of a company’s overall R&D spend
In practice there are unlikely to be significant changes for companies whose claims are based on employee costs, however those who either outsource or spend heavily on consumables or software relative to wages may ultimately suffer some form of restriction.
